This Privacy Policy explains how AM Shipping Network Ltd, trading as AM Vibe, collects, uses, stores and shares personal data when you visit amvibe.co.uk, contact us, create an account or place an order.

It also explains your rights under the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018 and applicable privacy and electronic-communications law.

1. Who is responsible for your personal data?

AM Shipping Network Ltd is the controller responsible for the personal data described in this Privacy Policy, except where another organisation explains that it acts as a separate controller.

2. Personal data we collect

The personal data we collect depends on how you interact with AM Vibe. It may include the following categories.

Identity and contact information

  • name;
  • billing and delivery addresses;
  • email address;
  • telephone number;
  • customer-account details; and
  • information needed to verify or administer an order.

Order and transaction information

  • products ordered, quantities and prices;
  • order, refund, cancellation and return history;
  • delivery method and tracking information;
  • discounts, promotions and gift-card information;
  • payment status and limited payment-related details; and
  • fraud-screening or transaction-risk results.

Complete payment-card details are processed by Shopify and the payment provider selected at checkout. AM Vibe does not receive or store your complete card number or security code.

Website and device information

  • IP address;
  • browser, device and operating-system information;
  • cookie and similar-technology identifiers;
  • pages viewed, links selected and searches performed;
  • referring website or marketing source;
  • shopping-basket and checkout activity;
  • approximate location derived from an IP address;
  • interaction dates, times and technical logs; and

Communications and customer-service information

  • emails, chat messages and contact-form submissions;
  • complaints, questions and support requests;
  • call notes where applicable;
  • photographs or documents you provide concerning an order, product, return or complaint; and
  • reviews, ratings and other content you choose to submit.

Marketing information

  • whether you have requested or consented to marketing;
  • your marketing and cookie preferences;
  • interactions with emails and advertisements, where legally permitted; and
  • campaign, audience and attribution information.

Information you choose to provide

You may provide additional information when asking whether a product is suitable for you or when making a complaint. Please do not send medical information or other sensitive information unless it is necessary for us to handle your request.

If you voluntarily provide information concerning your health, allergies or another special category of personal data, we will use it only where necessary and where an appropriate legal condition applies, such as your explicit consent or the establishment, exercise or defence of legal claims. We cannot provide medical advice.

We collect personal data:

  • directly from you when you order, create an account, contact us, join a mailing list, submit a review or request a return;

  • from Shopify and the applications used to operate our store;
  • from payment, fraud-prevention and identity-verification providers;
  • from fulfilment providers and couriers;

  • from publicly available sources where reasonably necessary to prevent fraud, protect our rights or meet a legal obligation.

6. Shopify and Shopify Network Intelligence

Our store is hosted by Shopify. Shopify processes personal data when you visit this store, use Shopify-powered features or make a purchase.

For core store services, Shopify generally processes customer personal data on our behalf. For certain services, payment functions or enhanced Shopify services, Shopify may act as a separate controller and process information under its own privacy documentation.

Shopify Network Intelligence is enabled for this store. This means Shopify may securely use customer information together with information from customer interactions with Shopify and other Shopify merchants to provide, develop and improve enhanced services. These services may include fraud protection, analytics, product customisation, advertising, ad measurement and personalisation.

Other merchants cannot directly access AM Vibe’s customer data through Shopify Network Intelligence. However, Shopify may generate insights or services using information from interactions across Shopify, subject to Shopify’s terms and privacy controls.

For UK visitors, non-essential device information must not be used for advertising or other non-essential Shopify Network Intelligence purposes unless the visitor has provided the required consent through the cookie banner or another properly integrated consent tool.

7. Organisations with whom we share personal data

We disclose personal data only where necessary for the purposes described in this policy, where you direct us to do so, or where required by law.

E-commerce, hosting and payment providers

We use Shopify to host the store, provide checkout and support store operations. Payment information may be processed by Shopify Payments or another payment provider selected at checkout.

Fulfilment and delivery providers

We share the information needed to prepare and deliver orders with our UK fulfilment provider and couriers. This may include your name, delivery address, telephone number, email address, products ordered and delivery instructions.

Couriers may include Royal Mail and DPD, depending on the service and destination.

Review provider

We use Judge.me to display reviews and, where appropriate, request feedback following a purchase. Relevant information may include your name, email address, product and order information.

Customer communications

We use services including Shopify Inbox to process chat messages and assist with customer communication.

Marketing, analytics and advertising providers

Subject to your consent and our configuration, information may be processed by providers such as Google, Meta, TikTok, Microsoft and our onsite marketing or popup provider. These providers may process cookie identifiers, device information, website interactions, campaign information and purchase events for analytics, advertising, attribution or personalisation.

These providers may act as our processors, joint controllers or separate controllers depending on the service and processing involved. Their own privacy notices explain processing for which they are independently responsible.

Technology and professional service providers

We may use service providers that support website operation, inventory synchronisation, order administration, email, security, data storage, auditing, accounting, insurance or legal services.

Authorities and legal recipients

We may disclose information to courts, regulators, law-enforcement bodies, tax authorities or other competent organisations where required by law or reasonably necessary to protect legal rights, customers or the public.

Business changes

If AM Vibe or its relevant assets are reorganised, sold or transferred, personal data may be disclosed to professional advisers and prospective or actual parties to that transaction, subject to appropriate confidentiality and data-protection safeguards.

We do not sell customer personal data for money.

8. Cookies and similar technologies

We use cookies, pixels, local storage and similar technologies for purposes including:

  • operating the website, checkout and shopping basket;
  • remembering preferences;
  • protecting transactions and preventing fraud;
  • measuring performance and website use;
  • personalising content; and
  • measuring or targeting advertising.

Non-essential analytics, personalisation and marketing technologies are used only in accordance with your consent choices where consent is required.

You can accept, decline or customise optional cookies through our cookie banner. You may withdraw or change your choice using the cookie-preferences controls displayed on the website. Withdrawing consent does not affect processing that occurred lawfully before withdrawal.

9. Marketing communications

We may send marketing by email or SMS where you have consented or where the electronic-marketing soft opt-in is legally available. You can unsubscribe at any time by:

  • using the unsubscribe option in a marketing message;
  • changing an available marketing preference; or

Unsubscribing from marketing does not prevent essential messages relating to an order, account, return, safety issue or legal notice.

10. International transfers

Some service providers, including Shopify and advertising or technology providers, operate in countries outside the United Kingdom. This means personal data may be accessed or stored internationally.

Where UK personal data is transferred to a country without applicable UK adequacy regulations, we require an appropriate transfer safeguard where required. Depending on the recipient and destination, safeguards may include:

  • the UK International Data Transfer Agreement;
  • the UK Addendum to approved EU Standard Contractual Clauses;
  • approved standard contractual clauses together with UK requirements;
  • binding corporate rules;
  • an applicable UK adequacy regulation, including an applicable UK extension to a recognised data-privacy framework; or
  • a specific legal exception where permitted.

11. How long we retain personal data

We keep personal data only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, tax, fraud-prevention and dispute-resolution requirements.

Typical retention periods or criteria include:

  • Order, invoice and tax records: normally up to seven years after the relevant transaction or financial period;
  • Customer-account information: while the account remains active and for a reasonable period afterward, unless earlier deletion is appropriate;
  • Customer-service and complaint records: normally up to two years after the matter is closed, or longer where needed for a dispute or legal requirement;
  • Return, refund, fraud and legal-claim records: for the applicable legal limitation period and any reasonable period required to resolve the matter;
  • Marketing records: until you unsubscribe or consent is withdrawn, with limited suppression information retained to respect your choice;
  • Reviews: while the review remains relevant and published, subject to moderation, deletion requests and legal requirements;
  • Cookie and consent records: for the period needed to demonstrate and manage your preferences; and
  • Technical and security logs: for a proportionate period based on operational and security needs.

We may retain anonymised information that can no longer identify you.

12. Automated decision-making and profiling

Shopify, payment providers or fraud-prevention services may use automated systems to assess transaction or account risk. These systems can consider information such as transaction details, device information, location indicators and previous activity.

An automated risk result may lead to additional checks, delayed processing or an order being declined. Where UK GDPR gives you rights concerning a decision based solely on automated processing that produces legal or similarly significant effects, you may ask for human intervention, express your point of view and challenge the decision.

Where you consent, advertising and analytics providers may use information about your interactions to create audiences, measure advertisements or personalise content. You can withdraw consent through the cookie-preferences controls.

13. Your data-protection rights

Depending on the circumstances, UK data-protection law may give you the right to:

  • access your personal data and receive information about its use;
  • rectify inaccurate or incomplete personal data;
  • erase personal data where there is no overriding reason to retain it;
  • restrict processing in specified circumstances;
  • object to processing based on legitimate interests;
  • object at any time to direct marketing;
  • receive or transfer certain personal data in a structured, commonly used and machine-readable format;
  • withdraw consent at any time where processing relies on consent;
  • challenge certain solely automated decisions; and

These rights are not absolute. We may need to retain or continue processing information where the law permits or requires it.

Please explain which right you wish to exercise and provide enough information for us to locate the relevant records. We may request proportionate evidence of identity where reasonably necessary to protect your information.

There is normally no fee. We may charge a reasonable fee or refuse a request where the law allows us to do so, including where a request is manifestly unfounded or excessive.

We normally respond within one month. Where a request is complex or numerous, the law may permit an extension of up to two additional months. If an extension applies, we will explain why.

Where Shopify acts as a separate controller for enhanced services, you may also exercise applicable rights through Shopify’s Privacy Portal.

16. Security

We use appropriate technical and organisational measures designed to protect personal data against unauthorised access, alteration, disclosure, loss or destruction.

Measures may include encrypted connections, access controls, account protections, service-provider assessments, monitoring and data-minimisation practices.

No internet service or storage system can be guaranteed to be completely secure. You are responsible for keeping your account credentials confidential and should contact us if you believe your account or personal data has been compromised.

17. Children’s privacy

Our store is not directed at children, and we do not knowingly collect personal data from children who are not legally capable of placing an order or providing the relevant consent.

If you are a parent or guardian and believe a child has provided personal data inappropriately, contact us so that we can investigate and, where appropriate, delete or restrict the information.
